Except as expressly stated in this Licence, or otherwise permitted in writing by IOP, the Customer and Authorised Users shall not in respect of Text and Data Mining: 2.1 perform systematic or substantive extracting of the Publications for the purposes of creating a product or service for use by third parties; 2.2 utilise the TDM Output to enhance institutional or subject repositories in a way that could compete with the value of the final peer reviewed articles in the Publications, or substitute and/or replicate any other existing IOP product, service and/or solution; 2.3 extract, develop or use the Publications in any commercial activity other than for Text and Data Mining; 2.4 abridge, modify, translate or create any derivative work based on the Publications, except to the extent necessary to make it perceptible on a computer screen to Authorised Users; 2.5 use any robots, spiders, crawlers or other automated downloading programs, algorithms or devices to continuously and automatically search, scrape, extract, deep link, index or disrupt the working of the Publications; and/or 2.6 substantially reproduce, retain or redistribute the Publications. 3. Authorised Users are free to use the TDM Output and any database rights created as a result of Text and Data Mining activities are the sole property of the Authorised Users. Such TDM Output shall be licensed under a Creative Commons CC-BY NC ND licence, include a link to the DOI of the applicable article wherever practicable and include a maximum of 200 characters from the original article. 4. Any rights of the Customer to carry out Text and Data Mining of the Publications shall only apply whilst this Licence is in force and, upon termination of this Licence for any reason, those rights shall cease automatically save in so far as they relate to any issues of the Publications in which the Customer has continued access rights under this Licence. Accordingly, upon termination, the Customer shall delete from their and all third party servers all other issues of the Publications that it has stored for Text and Data Mining, unless necessary for purposes of reproducibility. |

Taylor & Francis : Read and Publish - 2023-25 | Text and data mining | Permitted - Requires pre-approval from JHUP | Subject to Clause 4, where the Licensed Content is owned or licensed by the Publisher, the Institution shall be entitled to permit Authorised Users, for Educational and Research Purposes only: to download and makes single copies of the whole or any parts of the Licensed Material for the purposes of, and to perform and engage in computational analysis (including text and data mining) using the Licensed Material, aside from Commercial Use, and to permit Authorised Users to distribute and display and otherwise use (publicly or otherwise), other than for Commercial Use, the results, provided that i) such results do not reproduce the whole or a substantial part of any Licensed Content and ii) the Publisher has been notified in writing in advance of this use to ensure that they can provided the appropriate technical assistance and maintain a log of projects. Copies of Licensed Content made under this Clause 3.3.9 shall be deleted promptly after the computational analysis has been completed; Notwithstanding the aforesaid, copies made under this Clause 3.3.9 required to be made for purposes of research data retention by Licensee, if and to the extent needed to comply with government and/or funding body data management requirements, may be retained, either for such period of time as may be required by such government and/or funding body, or otherwise for so long as reasonably required to be retained by the Licensee for such purpose. The Publisher hereby acknowledges that any copyright and database rights arising from any computational analysis (including any text mining/data mining) of the Licensed Material referred to in Clause 3.3.9 shall, as between the Institution and Authorised User on the one hand, and the Publisher (and any licensor of the Publisher or other rights holder in the Licensed Materials), on the other, be the property of the relevant Authorised Users or the Institution, as the case may be. |
